Terms and Conditions of Use


Animalclass Ltd supplies online content to colleges, universitie, training organisations and businesses. These educational establishments, referred to as Authorised Members, pay an annual subscription to Animalclass Ltd. We grant a non-exclusive, non-transferable license to use the Course Materials for the sole purpose of education, and teaching within an educational context. 


1. All Users of the content at animalclass.co.uk

Authorised Members who pay an annual subscription either release the content on the Website, animalclass.co.uk, to their Users (students, staff, employees, tutors) OR import the content Files into their own virtual learning environment.

If, as an Authorised Member, you wish to import the Course Materials into your organisation’s virtual learning environment, an additional license and fee is required.

These are the Terms and Conditions (referred to as ‘Terms’) on which you may use the content on the animalclass.co.uk website (referred to as ‘Website’), and the online content/services available on it. The Terms and all Animalclass Ltd content apply to your use of animalclass.co.uk irrespective of the delivery platform you use – e.g. desktop PC, laptop, mobile device, PDA or otherwise – and irrespective of how the Animalclass content is delivered to you –e.g. web browser, Files, WAP browser, email, SMS or otherwise. In these Terms, ‘we’, ‘us’, ‘Animalclass’ means: - Animalclass Ltd, Baldoon, Burleigh, Stroud, Gloucestershire, GL5 2PW, United Kingdom, and ‘you’ means the User of this Website. 

By accessing www.animalclass.co.uk you are agreeing to the ‘Terms’. If you use animalclass.co.uk in the course of your employment of an Authorised member, you are agreeing to these Terms and Conditions on behalf of that business. Along with the Animalclass invoice these Terms constitute a binding agreement (“Agreement”) between you, in your capacity as a representative of the Authorised member, and Animalclass Ltd. 

The majority of Users access this site as a student (User member) studying with an Authorised Member or by paying for the Service, or on a ‘free trial’ In each of these cases you agree to be bound to the Terms and Conditions.

If you have entered this site by fraudulent means you are also bound to the Terms and Conditions but you are not recognised as a member/User by Animalclass Ltd. 

No amendments or variation of these Terms shall be effective unless made in writing and accepted by both of parties.

The receipt of services is personal to you and you may not transfer your rights to access the course materials, or to receive the services from another person unless we have consented in writing to you to do so.

If any provision of these Terms becomes void or otherwise unenforceable in whole or in part, the validity of the remainder of these Terms shall not be affected.

If either we or you fail to enforce or delay in enforcing any of our respective rights or remedies under these Terms, such failure or delay shall not operate as an agreement to waive that right or remedy. Neither shall it prevent us from exercising that right or remedy in the future. 

By using the Website you agree to be bound by these Terms, and the Private Policy Statement and the Copyright Statement. 

We reserve the right to amend these Terms from time to time. When we make a change we draw your attention to it on these pages. The date of the last revision to these Terms is provided at the end of the document. We recommend that you revisit this page from time to time to ensure that you are aware of any changes that we have made to these Terms. The continued use of the Website following any changes to the Terms will mean that you accept such changes.


1. Purpose of the Website

The purpose of the Website is to supply colleges, universities and training providers and businesses with engaging content that responds to requirements for the education of animal care, and animal management students.

Although the Website is openly available to all, it is specifically intended as learning materials. The information is not intended for diagnosis or medical procedures.


2. Copyright

Unless otherwise stated all content of the Website are © 2004 Animalclass Ltd. The materials on the Website are protected by our copyright and by third party copyright and other intellectual property rights as described in the Animalclass Copyright Statement. 3. Third party sites and services

Animalclass.co.uk contains links to other Internet websites and mobile services provided by independent third parties,(“Third Party Sites”) either directly or through separate Tabs. It also Third Party video on its website. Animalclass Ltd is not responsible for the availability or content of Third Party Sites and will not be a party to or in any way responsible for any transaction concerning goods or services available from such Third Party sites. If you purchase products or services from a Third Party site your contract for such products or services will be with the Third Party and not with Animalclass Ltd. Our Privacy Policy does not apply to Third Party Sites. 

Animalclass may contain indirect advertising, for example a photograph that names a manufacturer of a medicine. Animalclass will not be responsible for any error or inaccuracy in advertising or sponsorship material.


4. Linking

If you want to link to animalclass.co.uk please read and comply with the following guidelines and all applicable laws. A site or service that links to animalclass.co.uk: -

May link only to the homepage of animalclass.co.uk unless Animalclass has otherwise given prior written permission;

Must not in any way imply that Animalclass Ltd is endorsing it or its products or services;

Must not misrepresent its relationship with Animalclass or present false information about Animalclass Ltd;

Must not be a site or service that infringes any intellectual property or other right of any person or that otherwise does not comply with all relevant laws and regulations.

Must not be a site or service that contains content that could be construed as distasteful or offensive.

Animalclass Ltd expressly reserves the right to require that any link in breach of these Terms and Conditions be removed and to take whatever other action it deems appropriate.

If an Authorised Member imports the content Files into their virtual learning environment they are responsible for their own policy with linking.


5. Tracking an individual’s educational progress, and assessment achievements.

A learning management system is an integral part of Animalclass Ltd website, the purpose of which is to track an individual’s progression in a course(s). It also records and stores each User’s score when they complete multiple-choice questions and various assessments of learning. A tutor or employer of a User or Group of Users is able to use the learning management system to monitor the progress and score(s) of the Users. By using the Website a User agrees that the results from assessments on the website and a Users’ progress in a Unit(s) may be viewed by other persons. The Users are agreeing to allow tutors and employers to have access and knowledge of their scores and progress. Animalclass Ltd is not liable to an Authorised Member or User if progress reports or scores are lost or removed. Animalclass Ltd is not liable for damages if the progress or scores of User(s) become available to other Users or Authorised Members of the Website.


6. Intellectual Property

You acknowledge that all copyright, trade marks,and other intellectual property rights in and relating to Animalclass’s website and services are owned by Animalclass or loaned to Animalclass. It is easy to copy material that appears on websites but that does not mean it is legal to do so. Therefore, no-one may copy, distribute, show in public or create any derivative work from Animalclass, or any material which is found on the Website unless properly licensed to do so by us. The license is a separate document between an Authorised Member and Animalclass Ltd. You will be liable for any damage or harm arising from any infringement of intellectual property rights, whether belonging to the company or any other third party, if that damage or harm results in your act, omission or default.


7. Alerting Animalclass: errors, omissions, infringements

We have made every effort to ensure that the site content is accurate and up to date. However, we do not warrant the site and its content are error free or without omissions. Legislation, technology, protocols and medicines are constantly changing. You are agreeing to advise Animalclass Ltd of any errors, mistakes, infringements or other information, which affects this site and its content. We would be grateful if you would do this in a timely manner by e-mail or First Class post. We are delighted to receive suggestions, ideas, new procedures and any other information that will enhance, correct or improve the site. 8. General

These Terms are governed by and shall be construed in accordance with English law. Any dispute arising between us under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the English courts.

These Terms constitute the entire Agreement between us in relation to the provision by us to you of the Services, and they replace and supersede any prior arrangements between us in relation to the Services. You acknowledge that you are not relying on any statement made by us or any of our representatives with regard to the Services other than those expressly set out in these Terms, (which includes, for the avoidance of doubt, the description of the Services set out on the Website. Nothing in the Paragraph shall exclude or restrict our liability for fraud or fraudulent misrepresentation.

The Agreement between us which is comprised of these Terms is not intended to be for the benefit of any third party, and shall not be exercisable by any other person under the UK Contracts, (Rights of Third Parties) Act 1999, or otherwise.


9. Applicable to colleges, universities, training organisations, businesses, individual subscribers and free trial viewers who are referred to as Authorised Members. 

Animalclass operates the following ‘Paid for’ services: an annual subscription service for colleges, universities, training organisations and businesses to access its content at animalclass.co.uk or within its own virtual learning environment. By subscribing to receive this Paid for Service as well as the above Terms and Conditions you are also agreeing to the Terms in this section. Animalclass reserves the right to vary the Paid for Services and does not guarantee that a Paid for Service will remain paid for or that a free-of-charge/trial service will remain free-of-charge/free trial.

Animalclass reserves the right to suspend or terminate your subscription to the Paid for Services if you breach the Terms and Conditions, with or without notice and without further obligation to you.

Pricing: Animalclass will notify you in advance of any price increases. If we give you a free trial you will only be charged for your Animalclass subscription with effect from the expiry of that free trial period. Eligibility for any discounts is ascertained at the time you subscribe and cannot be changed during the term of your subscription.

Payment by an Authorised Member

To become an Authorised Member, you agree to pay us a license fee. The fee is determined solely by Animalclass. The price to an Authorised member of an educational establishment, training provider or business is usually based on the number of ‘their’ students accessing the Website, and to the number of employers/mentors who may be sharing the website with the students. 

You are liable to pay us the annual License Fee in full within 30 days after receipt of an invoice or the date specified in an invoice, whichever comes first. A late payment charge of one and one-half percent (1.5%) per month may be added to any unpaid balance after thirty (30) days. The fee is determined solely by Animalclass. 

Invoice: Animalclass Ltd's invoice is incorporated by reference into this Agreement, and all references to this Agreement shall include Animalclass Ltd's invoice. Along with the Animalclass invoice, these Terms constitute a binding agreement (“Agreement”) between you and Animalclass Ltd. If you are entering into this Agreement on your employer’s behalf, the Agreement applies to your employer and to you.


10. Warranties

Animalclass shall develop and operate animalclass.co.uk with reasonable skill and care and has reasonable security procedures in place.

Animalclass warrants that it will endeavour to remedy any faults in the Website of which it is aware.

Animalclass hereby disclaims all other warranties, conditions or duties of every nature whatsoever (except any duties of good faith), including without limitation, any implied warranties of satisfactory quality, merchantability or of fitness for a particular purpose, any express or statutory warranties, and any warranties or duties regarding accuracy, timeliness, completeness, performance, availability, lack of negligence, or of workmanlike effort. Neither do we provide any warranty that Animalclass is free from infection by viruses or anything else that has contaminating or destructive properties.

The Animalclass content available is only for your general education and use and is not intended to address your particular requirements. In particular, the Animalclass content does not constitute any form of advice, recommendation, representation, endorsement or arrangement by Animalclass and is not intended to be relied upon by Users in making, or refraining from making, any specific diagnosis or medical procedures. Appropriate independent advice or instruction should be obtained before making any such decisions. Any agreements, transactions or other arrangements made between you and any third party named on (or linked to/from) animalclass.co.uk are at your sole risk and responsibility.

Please note that specifically this site and its content are primarily educational and teaching resources aimed at teachers, lecturers, and students. Although the content is openly available to all to some extent, they are specifically intended as learning materials. The information is not intended for diagnosis or medical procedures. Under no circumstances should the content be used as a substitute for professional medical instruction, diagnosis or advice. Animalclass has no liability whatsoever and will not be responsible for the use of its information in medical or veterinary application. Information is intended for initial educational instruction.

You agree to use the Website and information in an ‘as is’ and ‘as available’ state. Information on this Website may be incomplete, out of date or inaccurate and may contain technical inaccuracies, or errors. Information may be changed or updated without notice.


11. Force Majeure

Animalclass shall not be responsible to you in the event that we cannot provide the Services to you due to an event beyond our reasonable control, which includes (but is not limited to) events such as fire, flood, storm, strikes or other industrial action, failure of telecommunications and other third party telecommunications services, war, riot, terrorism or the actions of any government or public body. In the event that we are prevented from providing the Services by such an event, we will take all reasonable steps to try to reinstate the provision of the Services to you as soon as is reasonably practicable.


12. Limitation of Liability

Except as expressly stated below:

(a) we shall not in any circumstances have any liability for any losses or damages which may be suffered by you (or any person claiming under or through you), whether the same are suffered directly or indirectly or are immediate or consequential, and whether the same arise in contract, tort (including negligence) or otherwise, which fall within any of the following categories:

(i) special damage even if you were unaware of the circumstances in which such special damage could arise;

(ii) loss of profits;

(iii) loss of anticipated savings;

(iv) loss of business opportunity;

(v) loss of goodwill;

(vi) loss or corruption of data,

provided that this paragraph shall not prevent claims for loss of or damage to your tangible property that fall within the terms of next paragraph (b) or any other claims for direct financial loss that are not excluded by any of categories (i) to (vi) inclusive above;

(b) our total liability of, whether in contract, tort (including negligence) or otherwise and whether in connection with access and use of the Website and (if relevant) use of an email account, shall in no circumstances exceed a sum equal to the Fees paid by the Customer; and

(c) you agree that, in entering into this Agreement, either you did not rely on any representations (whether written or oral) of any kind or of any person other than those expressly set out herein or (if you did rely on any representations, whether written or oral, not expressly set out herein) that it shall have no remedy in respect of such representations and, (in either case) we shall have no liability in any circumstances otherwise than in accordance with the express terms of these Terms and Conditions.

The exclusions above shall apply to the fullest extent permissible at law, but we do not exclude liability for:

(d) death or personal injury caused by the negligence of us or our officers, employees, contractors or agents;

(e) fraud or fraudulent misrepresentation;

(f) breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or

(g) any other liability which may not be excluded by law.

All references to us shall for the purposes of the above two paragraphs only be treated as including all our employees, all of whom shall have the benefit of the exclusions and limitations of liability set out in this paragraph.

Each provision of the Paragraph shall be construed separately as between you and us. If any part is held by a court to be unreasonable, inapplicable or unenforceable, then the other parts shall still apply.

Animalclass shall endeavour to remedy any faults in animalclass.co.uk of which it is aware.

We reserve the right to withdraw all or part of the website if it has been compromised.


13. Terms that apply to all Users when registering on the Website

As a User (Member) studying with or employed by an Authorised member or when paying for your own access or on a ‘free trial’ there are Terms to agree. 


To register as a New Account of the Website you must be at least 16 years old. You agree that the information that you provide to us on registration and at all other times will be true, accurate, current and complete and you agree that you will ensure it is kept accurate and up to date at all times. Animalclass may refuse to accept your application to register as a member of Animalclass for any reason at its absolute discretion.


14. Password security

You register by submitting your name, a user name and password, email address, college or place of learning which you attend and whether you are a Learner or an Educator. As you will be responsible for all activities that occur or are submitted under your user name and password, you should take care to keep your user name and password confidential. You must notify Animalclass immediately of any unauthorised use of your user name or password or if you believe that your user name or password are no longer confidential. Animalclass Ltd reserves the right to require you to alter your username and password if there is reason to believe they are no longer secure. If you know or suspect that someone knows your password you should notify us by contacting us immediately. The information that you provide to us upon registration and at any other time is subject to Animalclass Ltd's Privacy Policy.


15. Provision of the Services

Before you can gain access to the site you need to create a New Account. Once you submit your contact details an auto-generated email requests you confirm your profile details. When you confirm you gain access to the Website, animalclass.co.uk . To access the Units requires an enrolment key.  

Staff, other employees and learners who access the Website via an Authorised Member will be given an enrolment key to access the Unitsby their Authorised Member. If this information does not materialise contact ianlever@animalclass.co.uk


16. Your rights as a User to the Course Materials and your Related Obligations

The Course Materials are for the sole purpose of education, and teaching within an educational context. You may make copies of the Course Materials as they appear on the Website as necessary incidental acts during your viewing of it. You may print for your personal use so many pages of the Course Materials on the Website as are reasonable for private purposes, but not for reproduction.

Save as expressly set out in these Terms, you may not modify, copy, reproduce, re-publish, upload, post, transmit, or distribute in any way any of the Course materials. Any use of the Course Materials not expressly permitted in these Terms is strictly prohibited and will constitute an infringement of, either our copyright, or our intellectual property rights, and/or the copyright or other intellectual property rights of our licensors.


17. Ownership of the Website

All Animalclass Content belongs to Animalclass or its licensors. Animalclass Ltd or its licensors own all the intellectual property rights, (including copyright and database rights) in Animalclass Ltd's content and any selection or arrangement by Animalclass Ltd.

Content : You may for your personal, non-commercial use display Animalclass Ltd content on any compatible device.


18. Application of Terms.

These Terms and Conditions (‘Terms’) apply to the provision of course content on animalclass.co.uk(the ‘Website’) or when delivered within a virtual learning environment by an educational organisation such as a college or university or training provider, charity or business that subscribes to Animalclass Ltd .

Please read all the Terms carefully before accessing the content. ‘You’ are agreeing to ALL sections of this Agreement. Your primary contract is with the Authorised Member and not with Animalclass Ltd.

Animalclass Ltd is committed to protecting your privacy. Our objective is to provide members with a safe, secure and private environment. We have compiled this Privacy Policy so you know how we treat and protect your data. The Privacy Policy explains how all personal information collected via animalclass.co.ukis used. Please read it in conjunction with Animalclass Ltd’s Terms and Conditions as together they form the basis of our contract and commitment to you. 

If we change this Privacy Document, we will notify you of the changed document in the same way as we notify changes to Animalclass Ltd’s Terms and Conditions. 

The term ‘you’ applies to all Users (members) of this website, including casual browsers and ‘free trial’ browsers. 


These terms apply if you are an individual learner, student or employee of an Authorised Member. An Authorised Memberof this website includes educational establishments, training providers, charities or businesses who pay a subscription to Animalclass Ltd to access the content for the benefit of their members. Their members (Users) would include their staff, employees and the students who attend the establishment for study purposes. The Terms also apply if you are an individual User such as a learner, student, employee or contributor and register as a member and pay your own subscription to access the content, (very few members are individual Users). 

1. The information we gather:

Users of this website need to be aware of their rights and how to exercise their rights.

Animalclass Ltd collects information from you at registration. You provide your name, your email address, the name of the Organisation where you study, your status as a learner or educator, and your City/Town and Country. The details are available to you and can be changed if you notify us. 

We request the name of the Organisation where you study so that we can identify whether the Organisation subscribes to animalclass.co.uk. 

We collect information from Users (members) via the learning management system integrated within the Website, animalclass.co.uk. The system records individual’s assessment scores resulting from completing multiple choice questions and interactive games and it publishes each User’s results in their learning Account. It also tracks the progress of a User over the website. The information results in a User being able to return to the website with the opportunity to resume at the last place viewed. Further Information appears under the Cookiesheading. 

2. Sharing and the use of information                                                               

Contact details and email addresses: When you communicate with others through the Animalclass Ltd website, for example by email with other members (including contributors, tutors, employers, learners, students and employees), your name and email address becomes available to them. If you as a User are a registered student of an Authorised Member’s establishment, usually a College, University or Training Organisation, your contact details and email address is available to the Authorised Member which can include the tutors, employers, contributors, employees and students. Animalclass Ltd does not sell or give your contact details and email address to third parties. We do not use your contact details and email address for marketing purposes other than when communicating with Authorised members and their Users.

User’s Test Results: If you are a User of the assessment activities, your test results may be available to your tutor/professor/employer/mentor and other educational bodies. 

User’s Progress: when Users use the Website they consent to their progress being tracked by the learning management system. This progress may be made available to a tutor/professor/employer/mentor and educational bodies. 

Disclosure for legal reasons: we may receive requests from third parties with authority to obtain disclosure of personal data. We will only fulfil such requests where we are permitted to do so in accordance with applicable law or regulation.

Other Web Sites: our website contains links to other websites. This privacy notice applies to the Website animalclass.co.uk only. If you follow a link to other websites please note that these websites will have their own privacy policies and that we do not accept responsibility or liability for these policies. We also embed videos into Animalclass content that are hosted by other websites. Please check their policies before you submit any personal data to these third party websites.

When you accept our Terms and Conditions which includes our Privacy Policy you are accepting your exposure to the third parties and their own Privacy Policy. 

4. Cookies 

A cookie is information stored on your computer by a website that you visit. Cookies do not contain personal or private data about you, but can compile information about your browsing habits. For the most part, cookies enhance your browsing experience by keeping you from having to select the same options each time you visit a site. Different types of cookies provide different types of information. Some are needed to make the website work and we refer to them as Persistent cookies. 

Persistent cookiesare stored on your device and remain there until they reach the expiration date or you choose to delete them.Persistent cookies are set by Animalclass and allow our platform to recognise you when you use a unique identity. Our persistent cookies: -

You do not need to accept persistent cookies in order to browse our website. However, you must have persistent cookies enabled if you wish to make a purchase online from us, or access areas reserved for registered Users (members). 

Our Website works better with cookies enabled. Our cookies do not provide us, or anyone else access to separate personal data. However, you can choose to use your browser to delete and reject cookies on your computer. Third party cookiesarise when visiting other links within Animalclass and they are set by companies other than Animalclass. Their Terms and Conditions and Privacy Policy convey their own cookie policy. A third party could be, for example, Google Analytics which provides anonymous statistical data which can assist us when analysing the effectiveness of our content.

5. Marketing: we will not supply any personal data for commercial exploitation by a third party.

Listening to your views about our service can help us develop content you want. Please note that there may be instances where it is necessary for us to communicate with you for administrative or operational reasons. 

6. Security

We employ best practice policies and procedures to ensure data security.We have security measures in place to protect our customer database and access to this database is restricted to ourselves, writers, and staff working for Authorised Members, and prospective Authorised Members, (usually this is a College, University or Training Organisation where you study), and our website hosting partner.  

We employ appropriate use of encryption. We maintain our software and systems with security updates. We delete personal information after four years which should ensure access to the content for the full term of your studies providing your place of studies continues to subscribe to the website.
